Map Policy- EFFECTIVE August 12, 2024

The Minimum Advertised Price (MAP) policy set by Rusty's Offroad Products states that all authorized and unauthorized resellers of their brands must not advertise or publish any products for less than the approved MAP pricing. This policy applies to all forms of advertising, including social media, forums, billboards, catalogs, magazines, brochures, television, radio, and dealer websites. Violations of this policy may result in suspension or termination of the dealer's account at the discretion of Rusty's Offroad Products.

MAP Audits

Rusty's Offroad Products conducts pricing audits to ensure the resellers are adhering to the Minimum Advertised Price (MAP) policy. Any violations found during these audits will be logged, flagged and the dealer will be notified. If a dealer shows inherent disregard for the Rusty's Offroad Products MAP policy, has multiple violations, or engages in other forms of non-compliance, their account may be suspended or terminated. This is at the sold discretion of Rusty's Offroad Products.  

Do Not Sell (DNS) List Definition

If reseller or reselling distributor is added to the Rusty's Offroad Products DNS List, Rusty's Offroad Products will revoke the authorization of the reseller to purchase any SKU within the Rusty's Offroad Products for the determined period of time stated above. This revocation includes the cancellation of any and all pending orders, even if previously accepted, from the reseller, and no new orders will be accepted from the reseller.

Rusty's Offroad Products reserves the discretion to decide whether resellers remain on the DNS list indefinitely or have their purchase order access reinstated based on individual violations and circumstances.

Rusty's Offroad Products reserves the right without advance notice to modify, amend, enforce, or refrain from enforcing this policy as Rusty's Offroad Products deems necessary in its sole discretion.

If there is any dispute regarding the interpretation or enforcement of this policy, Rusty's Offroad Products interpretation will prevail. Resellers have the freedom to decide whether or not to comply with Rusty's Offroad Products MAP. However, violation of the MAP will lead to cancellation of all pending orders and no future orders will be accepted from the violating company.

Rusty's Offroad Products will consistently enforce this policy, and any actions by resellers that breach the policy will result in the loss of reseller status with Rusty's Offroad Products. Losing reseller status includes the revocation of permission to use any copyrighted material of Rusty's Offroad Products, including logos, marketing material, images, product descriptions, and company information.

Rusty's Offroad Products does not seek written or verbal acceptance of the terms of this policy. Each individual reseller can choose, at their own discretion, to comply or not comply with this policy. Non-compliance will lead to the termination of the business relationship between the reseller and Rusty's Offroad Products. This MAP policy does not constitute an agreement or contract between Rusty's Offroad Products and any of its resellers. This policy is non-negotiable.
